According to the text, if there is severe bodily injury and proof that there was no intention of the driver, the punishment will be imprisonment of 4 to 8 years – from 6 to 12 years in case of death
The House of Representatives Traffic and Transport Commission approved Bill 3755/24, which increases driver punishment who participates in ‘crack’ or performing hazardous maneuvers near schools, hospitals, public transport terminals or places with concentration of people. ‘Racha’ is an illegal race between vehicles on public roads. The rapporteur, deputy (Republicans-TO), recommended the approval of the text after adjustments. “I end the original idea, but apply the dosimetry that I consider more appropriate and proportional,” he explained. According to the approved text, in those areas and situations mentioned, if there is serious bodily injury and proof that there was no intention of the driver, the penalty will be imprisonment of 4 to 8 years. In case of death, the penalty will be imprisonment, from 6 to 12 years. The approved proposal changes the Brazilian Traffic Code.
As it is today
Today, in case of ‘crack’ or risky maneuvers, the law already provides for detention, from six months to three years, a fine and suspension or prohibition of driving. In addition, it also provides that:
In case of severe bodily injury and proof that there was no intention of the driver, the penalty will be imprisonment, from 3 to 6 years; and
In case of death and proof that there was no intention of the driver, the penalty will be imprisonment, from 5 to 10 years.
“The practice of ‘crack’, or street race, is a serious and dangerous traffic crime, but the worst consequence is the attack on human life,” said the perpetrator, Deputy Hugo Leal (PSD-RJ), in defending changes in legislation.
Next Steps
The project will still be analyzed by the Constitution and Justice and Citizenship Commission. Then you will go to the plenary. To become law, it will have to be passed by the House and the Senate.
