Kathlen was hit by a rifle shot on the chest on June 8, 2021, while visiting her maternal grandmother in the Lins de Vasconcelos community in Rio. I was pregnant 14 weeks.
The decision was taken by Judge Elizabeth Machado Louro of the 2nd Criminal Court, who considered that there is enough evidence to take the defendants to trial by the Jury Court. According to the magistrate, the materiality of the crime was proven by expert reports and technical examinations.
“Materiality is proven by the necropsy report, as well as by the injury schemes. The authorship equally sufficiently indicated in the case file, notably by the technical proof produced in the investigation. In this sense, although the oral evidence was not able to indicate that the shot that hit the victim departed from the accused, the simulated reproduction report arises sufficient to indicate the purposes of it. Decision, ”said the judge.
Despite the decision, the defendants await the trial in freedom. The jury date has not yet been set.

The case generated great commotion on social networks and mobilized family, friends and activists against violence. The baby’s father, in an emotional tribute, described Kathlen as “the most radiant and lively person he has ever known.”
According to the complaint of the prosecutor of Rio de Janeiro, the shots that hit Kathlen would have been Rodrigo Correia de Frias and Marcos Felipe da Silva Salviano, who were passing the community at the time of the incident.
The case was initially investigated by the Capital Homicide Police Station. At the time of death, the Military Police reported that the agents were shot by criminals, starting a confrontation. However, witnesses denied that there was exchange of fire.
