Spanish court nullifies damnation by Daniel Alves for sexual assault

Former player had been sentenced to 4 years and 6 months in prison, and had been on parole since March last year

São Paulo, SP (UOL/Folhapress)-The TSJC (Catalonia Superior Court of Justice) announced on Friday the annulment of the sentence that condemned Daniel Alves for sexual assault. The former player had been sentenced to 4 years and 6 months in prison, and had been on parole since March last year.

In a document published this Friday, the TSJC Appeals Section states that the sentence, February 2024, has a “analysis deficiencies”.

The decision to accept the appeal of Daniel Alves’s defense was unanimously taken among the members of the room.

The decision also states that “from the evidence produced, it cannot be concluded that the standards required by the presumption of innocence have been overcome” and recalls that the condemnatory sentences require a “reinforced pattern of motivation.”

The private accusation – representative of the woman who denounces the player – and the Spanish prosecutor may still appeal.

Still in the statement published on Friday, the TSJC states that the fact that it has annulled the sentence “does not mean that the true hypothesis is the one that sustains the defense of the accused.
