The has been without a decision on a precautionary measure presented by the technical area of the Court itself that investigates overpricing in the contract of installation of solar power generation systems in schools.
The last movement of the process occurred on December 10. Court resolution provides that the rapporteur has ten business days to decide on the request for precautionary, deadline from the formalization of the process.
The process involves hiring the City Hall of Recife, from Enove to install solar energy generation systems in schools in the Pernambuco capital. Report on the court’s technical area says that, after consultation with the federal government price panel, it found an average price of R $ 2,600 per KWP (kilowatt pico) unit in hiring by different bodies and entities of the federation.
Already the contract of the City Hall of Recife with the enove provided for the hiring of R $ 7,500 per kwp. Considering the total contracted quantity of 2,600 kWP, the pointed overpriced was R $ 12.5 million.
The technical area also said observing other irregularities in hiring, such as irregular adherence to the price registration minutes, lack of preliminary technical studies, participation of the project author in the execution of the service and improper use of price registration minutes as a “umbrella” type contract.
Sought, the ECA reported that the process is under analysis of the rapporteur, counselor Dirceu Rodolfo. The court states that two main reasons have made the process yet, the first of them being the change of rapporteur.
“Counselor Eduardo Porto, original rapporteur of the process, declared himself prevented to judge him. Thus, the process was redistributed, via draw, to advisor Dirceu Rodolfo, who needed more time to know the details of the case,” he says.
ENOVE belongs to businessman Álvaro Porto de Barros Filho, son of Álvaro Porto (PSDB), current president of the State Legislative Assembly. He was responsible for articulating the appointment of Eduardo Porto for the position of Counselor in 2023.
In a statement, the city reported that “all hires respect the appropriate administrative rites, striving for legality and economy.” “Regarding the process cited, this is a preliminary report, and there is no decision by the Court of Accounts – and, as soon as instated, the management will present the necessary clarifications.”
