STF rejects Bolsonaro’s appeal about conviction in the TSE

Former president was convicted of irregular propaganda against Lula in the 2022 election campaign

The 1st Panel of the Supreme Court (STF) has a majority to maintain the former president’s conviction for irregular electoral propaganda in the 2022 elections. The magistrates rejected an appeal filed for the defense of the former executive’s chief.

The decision confirms the understanding of the TSE (Superior Electoral Court) that there were irregularities in the boost of negative content against the then candidate (PT), Bolsonaro’s opponent in the election.

The case is in a virtual plenary, where the Supreme Ministers place their votes in the court system and there is no discussion in plenary.

Flávio Dino, rapporteur of the case, voted against Bolsonaro’s defense request. He was accompanied by the ministers Cármen Lúcia and Alexandre de Moraes. In his vote, Dino said that the TSE conviction was based on electoral legislation and that it would not be appropriate to analyze the case once again as requested by the former president’s defense.
