The Secretariat of Finance and Planning of the State of Giving this Tuesday (1st) to an action with about 300 large energy consumers, such as hospitals, shopping malls and banks, to pay ICMS on two rates related to the sector.
The estimated value for revenue management is about $ 700 million.
The action, of “self -regularization”, follows the decision of the Superior Court of Justice (STJ), which determined that the values of the Distribution System (TUSD) and the transmission system use tariff (TUSD) are part of the tax calculation basis.
TUSD is a tariff charged for consumers to finance the maintenance of the electricity network, and TUST, to conserve the transmission network.
Since March 2017, these consumers have failed to collect ICMS on injunction -based tariffs.
Now, with the court decision, they will begin to receive notifications and will have 60 days to regularize their debts spontaneously. After this period, there will be inspections and penalties by the state government. Payment may be the cash or installment.
