The case of Jaime Junkes has become a symbol for pockets in defense for the approval of the bill that grants amnesty to the accused of the attacks of January 8. The (Attorney General’s Office) was against the home arrest of the retired teacher.
Moraes made decisions in favor of four other accused of participating in the coup camp in front of the Army Headquarters in Brasilia.
One of the loose was businessman Leonardo Henrique Maia Gontijo, 34. He had been arrested on February 25 for breaking precautionary measures imposed by the Supreme, such as the ban on leaving the county.
The arrest had been decreed by Moraes in November, but Leonardo moved from Belo Horizonte to Viçosa (MG) and was only found three months later. He was arrested as the Supreme Court judged his process.
Leonardo was sentenced on February 28 to a year of imprisonment for crimes of criminal association and incitement to the crime. Because it is small, the penalty was replaced by alternative measures, such as the prohibition of leaving your city and the obligation to take a course of the Federal Prosecutor’s Office on democracy.
The case is similar to that of Isaias Ribeiro Serra Júnior, 24. The Bahian, a martial arts teacher, returned to prison last June for frequently breaking the precautionary measures.
Bahia court reports showed that Isaiah left the anklet battery over 17 times – in some of them, the equipment was not working for a day.
Bahian court inspection was four times to Isaiah’s house to change the equipment and the porter, but the infractions did not cease.
The martial arts teacher was sentenced to one year of imprisonment, with the imposition of alternative measures on November 26. But he only had the freedom granted by Moraes last Monday.
Reginaldo Silveira, 60, also left the arrest by Moraes’s decision on Monday. He was accused by PGR for criminal association and incitement to the crime because he camped in front of the Army HQ in an undemocratic manifestation.
He was arrested from January 9, 2023 to 10 March of the same year, when he left the prison in Brasilia on the condition of complying with precautionary measures. However, he failed to comply with electronic monitoring, with 73 occurrences related to the electronic anklet.
Therefore, he returned to arrest in July 2024. He was only released from prison earlier this week, while still awaiting trial.
The other accused who returned to freedom was Kenedy Martins Colvello, 29. He was sentenced to the same penalty of one year of imprisonment, with the imposition of alternative measures last Friday.
Kenedy has been in prison since January for breaking precautionary measures. The court records indicate that the accused was six days in a row away from home. The defense argued that the defendant needed to travel frequently by the state of Santa Catarina because he is a dog trainer and has clients spread in several municipalities.
