The minister, of the (Supreme Federal Court), decreed the arrest of Leo Indian, cousin of the children of the former president (), accused of participating in the attacks of 8 January 2023.
The decision complies with the request of the Attorney General of the Republic ,. According to, Leo Indian fled to Argentina even with the passport canceled by the Supreme since January 2023.
“It appears that the defendant has shown a wide intention to leave the national territory for the purpose of evading the district of guilt, since the accused is fully aware of the cancellation of his passport, deliberately fled from Brazil, having entered Argentina with the identity document, due to the unnecessary passport presentation in Mercosur countries,” Moraes said.
The decision was made by Moraes on Tuesday (1st) and published on Wednesday (2). The minister says that the provisional permanence document of Leo Indian attached by the defendant’s defense in the case file, which shows authorization to remain in the country until June 2025, is proof that his intention was to escape Brazil at the risk of conviction.
“The evident escape from the district of guilt by virtue of receipt of the complaint against the defendant demonstrates the legitimacy of imposition of pre -trial detention to ensure the application of criminal law,” said the minister.
Leo Indian became a defendant in the Supreme for participation in the attacks of January 8 in a virtual session of the first class closed on February 28. He is accused of committing five crimes, including coup d’état and armed criminal association.

In the video, Leo Indian criticizes the PL and the mayor, Hugo Motta (Republicans-PB), for not prioritizing the approval of the bill that grants amnesty to the accused for participation on January 8.
He also said he had a provisional permission to stay in Argentina, a document that needs to be renewed every three months.
Leo Indian lived in southwest of Paraná, near the border with Argentina. The country requires only identity to allow Brazilians to enter. The suspicion is that the defendant has entered the country less than a month ago.
Gonet called for the pre -trial detention of Leo Indian on Tuesday, days after the defendant’s defense submitted evidence of his trip to Argentina and communicating the Supreme Court on a request for refuge for the government of Javier Milei.
“In evading to Argentina, Leonardo Rodrigues de Jesus deliberately disregarded an alternative precautionary measure to prison, to highlight his insufficiency, the neglect of the application of criminal law and disrespect to decisions issued by the Federal Supreme Court,” Gonet said.
In the Supreme Petition, Gonet states that on January 19, 2023, the minister decreed precautionary measures against him, among them the cancellation of all passports issued on behalf of the defendant, including the adoption of the necessary measures to prevent the issuance of new documents.
“The ontology of the precautionary measure of cancellation of passport aims to prohibit the defendant of the defendant of the country,” said Gonet.
