AGU recommends transparency in janja spending

Text signed by Jorge Messias says that acting of a first lady has “its own nature”, but defends accountability and disclosure of agendas

The (General Advocacy of the Union) published on Friday (4.ab.2025) a compulsory normative instruction regarding the performance of the husband or wife of a President of the Republic. Among the measures, the agency recommends transparency actions and does not authorize that the president’s partner or partner assume formal commitments on behalf of Brazil.

The document was requested by Planalto Palace, After the President’s wife (PT), Janja da Silva, criticizing the lack of dissemination of information related to official agendas.

Signed by the Minister of AGU, Jorge Messias, the text recognizes that the performance of the President’s wife has “Own legal nature”which allows the performance of representative and symbolic activities of social, cultural, ceremonial, political and diplomatic character.

However, the performance must observe the principles of public administration, as determined by article 37 of the Federal Constitution of 1988. Here (PDF – 121kb).

Here are the recommendations of AGU:

  • “The performance is sui generis (unique), voluntary and unpaid in nature”;
  • “It is not authorized to make formal commitments on behalf of the Brazilian State”;
  • “It allows to exercise, to some extent, the representation of the President of the Republic, in the context of a symbolic language recognized by the custom”;
  • “State support must be strictly linked to the public interest and the needs arising from this action, based on the legal system”;
  • “Both the presidential spouse and the public agents who support them must observe the principles of advertising and transparency, through: rendering of accounts on displacements and public resources used; dissemination of the public commitment agenda; Provision data on expenses and travel in the transparency portal; compliance with information related to these activities.”

The orientation also recommends that the Presidency of the Republic will establish an internal administrative flow to formalize the incumbers attributed to the President’s woman in symbolic representation activities. The measure aims to give a legitimacy to actions and ensure the resources necessary for its fulfillment.

In addition, it recommends that, on a case by case basis, the incidence of restrictions on access to information is evaluated, especially when there are constitutional or legal grounds, such as safety reasons or protection of intimacy.
