The Bill No. 4,690/2024, of the deputy (MDB-AL), prohibits the suspension of social networking profiles of candidates, restricting punitive measures to the removal of specific posts that breach electoral legislation. The goal, according to the congressman, is to guarantee freedom of expression and the wide dissemination of ideas during the election period.

According to the text, the profiles may not be completely suspended or blocked the date of registration of the application until the end of the electoral period. If the infringement of electoral rules is found, the Electoral Court may exclusively determine the removal of specific posts or publications with irregular content.
In Brito’s assessment, total suspension of profiles on social networks can disproportionately compromise the right to electoral propaganda, impairing the dialogue between candidates and voters.
“The electoral period is characterized by the intense exchange of information, debates and propositions, with social networks being essential tools for the diffusion of ideas.”said the author of the project. “Thus, it is essential that the Electoral Justice acts in a balanced way, ensuring that any excesses are corrected without compromising the full exercise of the election campaign.”
The prohibition stipulated in the project does not apply to cases where the profile is used exclusively for illegal purposes, provided that the conduct is proven by definitive judicial decision.
Next Steps
The project will be analyzed by science, technology and innovation committees; and constitution and justice and citizenship before being voted by the House Plenary. To become law, the measure needs to be approved by deputies and senators.
