Project stipulates 120 -day license to pregnant intern

The PL (bill) is under review in the House of Representatives. The text amends Law 11.788/08, which deals with the internship, to guarantee the pregnant trainee the right to a license of 120 days. During the period, the interns will continue to receive scholarship, except if they already receive the maternity salary, but will no longer be entitled to transportation aid.

Under the proposal, the license may be requested from the 28th day before delivery. The removal, before and after delivery, may be increased by two weeks each, by medical certificate. Read the project (PDF – 110 KB).

The proposal is authored by the deputy (Republicans-SP). She says the license cannot be used as a reason to remove financial aid from the intern.

“This removal cannot cause damage to the intern, neither financial nor educational.”justified the congressman.

The proposal also guarantees the pregnant trainee the provisional stability from confirmation of pregnancy to delivery, including the period of the license – which is also granted in cases of abortion allowed by law for a period of two weeks.

Teleworking

The text also guarantees the priority to the internship in the teleworking modality for pregnant interns, as well as for interns and trainees with child, stepson or child under judicial custody with up to 6 years.

Next Steps

The project is processed in conclusive and will be analyzed by the Committees of Defense of Women’s Rights; of work and constitution and justice and citizenship. To become law, the measure needs to be approved by deputies and senators.
