Opinion states that compensation seeks to “minimize negative financial impact” for magistrates called to work in the Supreme

The president of the Supreme Court (STF), Roberto Barroso, signed a resolution of the Court, instituted on Thursday (27.mar.2025), which benefits assistant judges and instructors acting in the offices of the ministers. They can be reimbursed at over R $ 10,000 “for losses arising from the call ”. Ice A (PDF – 130 KB).

The amount would be a substitution to the daily paid to magistrates from other regions and to compensate for changes related to change when they are called to act in the Supreme Court in Brasilia.

The news was published by Estadão with the title: “Barroso creates a new benefit of R $ 10,000 monthly for auxiliary judges of STF ministers”. In a note sent to the newspaper and shared with the Poder360however, the minister denies the creation of an extra expense, more than a installment previously charged as cumulative nights will now be charged as compensation. Stated that this is a purely bureaucratic change of a long -time benefit and that the Decision was collegiate, not from the President of the Court.

“It is a benefit paid to judges who are requested from their courts of origin, work far from the family and have new expenses, such as the payment of rent. Life in public service is already difficult enough to have to have routinely living with evil.”declared.

The benefit will be corrected annually by the IPCA (Broad National Consumer Price Index) –Logo, it will not have inflationary losses either.

Technical opinion sent by the STF ( – PDF – 186kb) explains that the position of judge assigned to the Court establishes financial losses and that intends “Minimizing the negative financial impact that a call results in the magistrate’s remuneration.” An example is the loss of financial compensation for the accumulation of the collection and the possibility of performing the electoral function.

The opinion also explains that when a magistrate is temporarily assigned to STF, he does not lose his judicial bond of origin. This ensures the right to daily and passages. The document also says that the compensatory portion does not cost housing in the Federal District and that the remuneration refers to the exercise of activities outside their jurisdiction. Only judges moving with the family to the federative unit receive housing assistance (Read the table below).

“It is relevant to note that the remuneration aspect is a factor to be seriously considered as attractive for judges candidates to act in the Federal Supreme Court. It is necessary to minimize the negative financial impact that a call results in the remuneration of the magistrate.”says the document.

As part of compensation measures, the resolution also states that when a judge from another court is assigned to the Supreme Court, he will receive an additional that equates his salary prior to that of the Ministers of the STJ (Superior Court of Justice).

In addition to this benefit and indemnity for losses resulting from the call, the resolution guarantees allowance, housing allowance, functional property, annual airfare quota to return to home housing, official travel rates and the use of a court mobile phone or the reimbursement of its own mobile phone account.
