The president of the (Supreme Federal Court), made the revision of a benefit to judges acting on court offices.
Resolution signed by the minister states that auxiliary judges or instructors will receive $ 10,000 monthly in compensation for those who move to Brasilia to assume these functions.
Today, the court has 37 auxiliary judges or instructors, 32 of them from outside the capital. The resolution was signed on March 28 and regulates the convening of auxiliary judges and instructors in the Supreme.
In the case of indemnities, the benefit replaces the payment of daily paid to requested magistrates. The funds received by them in the same amount are now called compensation for losses arising from the call.
The information was first released by the newspaper O Estado de S. Paulo.
In a previous change, the Court increased the value destined to the daily. From February 2024, each judge summoned was entitled to up to six daily per month, or R $ 10,000 a month, an increase of R $ 4,000 compared to the previous amount previously.
Each may act at court for a maximum period of two years. By the rule, each minister may call up to three judges. However, there is openness to increase teams in exceptional cases.
In a statement, president of the Supreme said there was no increase in expenses with the standard.
“The central point is that there has been no new benefit creation, only the bureaucratic change of a long-time benefit. It is a benefit paid to judges who are requested from their original courts, work away from family and have new expenses, such as rent payment,” said Barroso.
The benefit, according to the standard, will be corrected annually by the (National Consumer Price Index), but may be “substantially reduced by budgetary necessity”.
The magistrates summoned may also have aid of cost, housing allowance, functional property, annual airline ticket, for returns to the jurisdiction of origin; daily, on official trips; Use of court mobile or reimbursement of its own appliance account.
In cases where the judge chooses a housing allowance or functional property, the text provides for the amount of a full housing allowance of the indemnity.
The value of housing allowance to these magistrates was updated in 2013, by act of then President Joaquim Barbosa, and currently corresponds to R $ 4,158.85. The amount corresponds to 95% of the amount that would be due to the STF minister and is, according to the Court, “frozen due to successive adjustment seals provided for budget guidelines laws.”
Finally, those who ask for allowance to move to Brasilia are not entitled to the annual airfare quota.
The figure of the auxiliary judges was created in 2007. In 2008, these magistrates were entitled to housing allowance who already received those who performed the same function in the (National Council of Justice).
Also in 2008, an internal opinion was favorable to receive airline tickets by assistants.
The creation of the position of instructors was in 2009, to perform the interrogation and other acts of the instruction of criminal investigations and original criminal actions.
