The Labor Court ordered Havan, to pay compensation of $ 5,900 to a former employee for electoral harassment.
In the action, the former employee, who worked at the company as a Junior Fiscal from February 2020 to April 2022, reported that the store manager in Jacareí (SP) did not accept political conversations that were contrary to then President Jair Bolsonaro (PL).
She said a colleague was fired for that reason, and that the manager said the store would close the doors if the PT won the election.
Judge Fabrício Martins Veloso stated in the sentence that the pressure on employees was proven so that there was no vote in a party contrary to that adopted by Luciano Hang.
and even said in the 2022 campaign that stores could close if he lost the election.
Citing that the company does not use boxes with number 13, the judge said that “abusive embarrassment was evident.”
Havan, who has appealed the sentence, told court that it has been elected for years as one of the best companies to work with.
He said the employee was never exposed to any pressure or embarrassment and that Hang’s manifestations have always observed her free expression rights, never representing any threat.
“The defendant’s owner’s political preference is common [a Havan]and such a position was not taken into your company, “said lawyer Carlos Augusto Malhadas,
The defense also mentioned that the boxes of Havan’s stores do not take number 13 for private reasons of the businessman, and that it is so since its foundation in 1986.
“No robust evidence has been produced about the alleged moral damages,” the company told the court.
The appeal has not yet been analyzed.
