The Krenak, traditional inhabitants of the territory located on the banks of the Rio Doce, in Minas Gerais, seek in court the financial reparation by the call during the, a story marked by episodes of.

The request is the subject of a public civil action, authored by the MPF (federal), delivered to the Federal Court on the 28th of last month. THE Sheet had access to the document.

In the action, which narrates part of the tragedy experienced by the Krenak people in the 1960s and 1970s, the MPF calls for a collective reparation of R $ 10 million for the indigenous expelled from their original lands, in the municipality of Resplendor (MG), and who began to live in the village vanuíre, in the municipality of Arco-Íris, in the interior of São Paulo, over 1,200 km away from their original home.

The Attorney’s Office also claims individual payment of R $ 50,000 to 22 indigenous people, including elders still alive and descendants of victims, totaling another R $ 4.4 million in financial compensation.

The (Attorney General of the Union), which defends the Union in these cases, has already been communicated on the matter and will deliver its defense. The trial has no date to happen.

. In 1969, it was installed where the so -called “Krenak reformatory” lived, a space that was actually used for various types of violence against indigenous people. These actions had the performance of the Indigenous Rural Guard, which was managed with direct participation of its own (National Indian Foundation) and state and federal authorities.

A, including with public registration of torture during official ceremony ,. The interest in the land at the time was to make room for mining.

Many indigenous people were compulsorily removed and removed under military escort. Placed in cargo wagons, they were sent to a property about 300 km away (Guarani Farm), in Carmésia (MG), an unproductive land donated by the Minas Gerais Military Police. In this place, they lived under surveillance, in a nearly prison regime, for about eight years.

Part of the ethnicity fled and moved to the village Vanuíre, in the interior of São Paulo, where indigenous people from other ethnic groups were already lived. Chief of the village, Lidiane Damaceno Krenak says that many of her relatives traveled three months through the roads and land until she arrived at the scene, fleeing military violence.

“I was born in Vanuíre, but I have grandparents, parents, uncles and cousins who lived this tragedy. Many could not go back there, because of the trauma and the sadness that all this represents,” he told the Sheet.

Living to this day out of their ancestral territory, the village vaniure krenak decided moral and social. Lidiane Damaceno is among the 22 indigenous people who ask for individual compensation.

“Nothing can erase or repair everything our people have lived, but it can serve as a minimal gesture to help our families to move on,” he said.

In 2021, the court had already recognized an action filed by the MPF in Minas Gerais since 2015 and ordered the liability of the Union, the State of Minas Gerais, Funai and the former captain of the Military Police of Minas Gerais Manoel dos Santos Pinheiro for violations of the rights of indigenous peoples, especially the Krenak, during the military dictatorship.

Captain Pinheiro was responsible for implementing the paramilitary force composed of indigenous people. He was denounced by the MPF in 2017 for genocide crime against the Krenak people. He died in 2023, before being tried.

This initial process filed by the MPF did not include financial values. It was a public recognition and apology, as well as the determination for Funai to finalize the process of identification and delimitation of the Krenak Indigenous Land of Seven Halls (MG).

The action included measures for those who stayed in the village Vanuíre, so Lidiane Damaceno says, there was a decision to file a new indemnity action.

Resident of RESplendor (MG), told him to Sheet who learned of the new action of the MPF for the report, but celebrated the progress of the new measure presented by the indigenous of the ethnicity that live today in the interior of São Paulo.

“. If Captain Pinheiro were alive, maybe he would be laughing at us around. Then I see this new prosecutor action as something welcome, and that justice realizes that he let 50, 60 years of abuse and are now trying to run after,” he said.

Elected member of the Brazilian Academy of Letters in April last year, he cites indigenous families of resplendor who, in his understanding, could also have been included in the action.

“I hope that justice understands that these values do not compensate for suffering, the damage, the discontinuity of life that was imposed on all these families, including those who have died. My question is why they do not enter the repair list. They are also entitled,” he said.
