The councilors of () and (PL) presented a bill in the City Council of São Paulo that makes the burial of birth and stillbirth, “regardless of gestational age, body weight or height”.
The text prohibits the “destination not consistent with the dignity of the human person, admitting, at the discretion of the bereaved family, the option for the cremation procedure”. And determines that a death certificate is delivered to families.
An ordinance of determines that, in case of fetal deaths, doctors are required to provide the death declaration when the pregnancy is duration of 20 weeks or more or the fetus has a body weight equal to or greater than 500 grams. When the fetus does not reach this level of development, the hospital forwards the biological material for incineration.
In justification, parliamentarians state that the project presented aims to defend “the dignity of human life from conception”. And it is a “measure of respect and empathy with families facing the early loss of a child.”
The proposals were presented separately. To the column, Pavanato says that they should be processed together and that the text resembles a project presented by the councilman of São José dos Campos Sérgio Camargo (PL).
The PL adds to a series of other projects presented by Pavanato that aim to undermine access to legal in the city. One of them, for example, makes it mandatory to present the police report that “attests the truth of the rape” to perform the procedure.
He says, however, that the project was not thought of with this goal, but to “emphasize the dignity of the human being.” Already Martínez states that “while the country discusses the right to interrupt life, I propose that we start respecting those who have already lost it.”
