The general director of the National Transplant Organization (ONT), Beatriz Domínguez-Gil, is a candidate to obtain a fixed place in the autonomous body that she leads. Domínguez-Gil has been presented and has been admitted for a selection for medical personnel in its center, within a process whose organization of the evidence and proposal of court composition depends on the Ont itself. The entrustment to be the agency who manages these processes and proposes the members of the Court to Health by Domínguez-Gil itself and the Undersecretariat of the Ministry of Health, days after the call of the square appeared. The high position argues that he has the right to opt for that place, to which seven other candidates attend, and that it would allow him to be fixed after almost 20 years working without being for the transplant agency.
Among other powers in the process, the organization, which coordinates at the national scale the organ transplants in the country that chains, has to propose the members that are part of the courts of the selective evidence. The composition proposal started from the General Secretariat of the Transplant Agency, confirms to this newspaper Domínguez-Gil. The president of the Court is the head of the Medical Service of the ONT, appointed by her upon arrival in office, in 2017.
The initial selective process court was composed of five titular members, three of them Personnel of the ONT itself. But several titular and alternate members have asked to be replaced. Among them, the secretary, María del Mar Carmona, has resigned, which is a superior technique in the ONT.
To the question of why in court there are people who depend hierarchically on Domínguez-Gil, a high spokesman of the Ministry of Health points out that they have already been replaced, last March, by other people who do not belong to the ONT. However, it is not necessary that among them the president of the Court has been replaced, hierarchically dependent on the candidate. The Ministry refers to the “technical discretion” of the court that “Motu proprio“You can identify incompatibilities.
This newspaper has had access to writings to be renouncing to be part of the court, among which designated members, it emphasizes that “Article 23 of Law 40/2015, of October 1, on the legal regime of the public sector establishes as a reason for abstention in section e): ‘have a service relationship with natural or legal person directly interested in the matter, or have given it in the last two years professional services of any kind and in any circumstance and in any circumstance”. But, despite this, the President of the Court, directly appointed by a candidate for the process, does not know that he has resigned.
In addition to proposing the composition of the court and other aspects of the process, the agency that directs manages the requests for participation, the proposal of admitted and excluded, and the dates and place of celebration of the exercises.
The director, who has been 19 of her 54 years at the ONT, argues that she is presented to the square because she has been working since 2006 in the agency, first as “foot doctor” and then as general director – that is, by political designation – but always without fix. “When I joined more than 50% of the workforce, it was interim. Until I was appointed general director there was never any stabilization process,” he explains to El País. “In 2018 I received the health task of doing a stabilization process, to which I would have wanted to present myself, but, as I had to conduct it, I could not. The dilemma was or present myself and stabilize my work situation or direct the process.” Domínguez-Gil opted for the second “for responsibility with the agency.”
The doctor ensures that the stabilization responds to an indicative of public function that affects the ONT as “workers of all ministries” and that the merit contest for her place takes into account “the time worked” and in no case “being director”, something that “has no value within the contest, with an objective assessment.”
The basis of the process, published in the BOE on November 22, 2024, collect that it is necessary Researcher
“I am high position and depending on a political designation,” says the general director, appointed in the last stage of the PP government, although he has no record or fear of being ceased after eight years in office under administrations of different political sign: “I have no concern about my continuity.” And, in fact, Domínguez-Gil emphasizes that he is considered “a victim of the system” for not having “a lot of time dedicated to public service.” “I have practically all my professional life in an organism that I think is model and to which I dedicate 24 hours a day and I find myself in this situation,” he explains.
The director shows this newspaper that she has doubts about whether or not she will continue in the process, because she affirms that she has attended another of public employment in the Community of Madrid as a specialist in Nephrology and that she appears second in the resulting selection.
The legislation that regulates the exercise of high positions of the General State Administration (Law 3/2015) collects in its article 11.2 that “it is understood that a high position is incurred in conflict of interest when the decision that will be adopted (…) may affect their personal interests, of an economic or professional nature, by assuming a benefit or damage to them”. Also, the basic statute of the public employee in its article 52.5 indicates that “they will refrain in those matters in which they have a personal interest, as well as all private activity or interest that may be a risk of raising conflicts of interest with their public position.”
A senior spokesman of the Ministry of Health points out that the position to which Domínguez-Gil is part of a general process of fixed places offers to end the temporality in the public sector. The director, in interim, has “all the right to present” and health does not see that there is “conflict of interest” in which a general director who has been in interim employment situation since 2006.
Another candidate: “I never gave a cent in the square”
In the provisional list of admitted applicants published by the Undersecretariat of the Ministry of Health last March, Domínguez-Gil appears in a provisional list of eight applicants to a single place to incorporate a specialist doctor as fixed personnel. The position is, therefore, level A1, the highest rank within the classification system of public employees. The director appears in second position in the list, although this is not ordered by order of priority, but by alphabetical order of the surnames of the candidates.
Andrés Roncacio, an immunologist in unemployment, is another candidates admitted to the process. Until the publication of this information, I did not know that I shared put on a list with the general director of the center where she wants to work. “This is the product of the precariousness in which many officials and options are found in the country, eternal interim,” he says. “It’s the third time I’m unemployed in three years and knows how much it costs to train a specialist,” he laments. He learned of the call “rebound” and states: “I never gave a tenth for the square.” He is accustomed to this type of processes. “In many of the hospitals practically everything is already assigned by Dedocracy”, He says.
The place for which he competes is for a specialist doctor and derives from the call to which Domínguez-Gil resigned to present himself. That call, after resolving, left one of them, for a specialist in preventive medicine and public health. Instead, the position that is now offered is for a specialty doctor of any specialty. Domínguez-Gil is a nephrologist and, if the requirement of the first job offer has been maintained, he could not have opted for him. The doctor says that in “the ONT, when plazas are covered, [estas] They do not go with particular specialty. ”From the Ministry of Health, the spokesman says that” for this process, which is massive, for stabilization the places without specific specialty are removed. “
Domínguez-Gil was appointed General Director on May 12, 2017 at the proposal of the then Minister of Health, Dolors Montserrat, of the PP. The ONT, founded in 1989, is an autonomous public body, attached to the Ministry of Health. In 2010, the Prince of Asturias Award in International Cooperation “for its determining work in the establishment of medical and ethical principles that govern clinical processes and scientific research related to transplants” was received together with The Transplantation Society. Since the year of appointment of Domínguez-Gil, the ONT has a general direction range of the Ministry of Health. In 2022 he received a salary of 90,762.38 euros gross per year, according to the portal.
The organization has as a mission “to promote donation and transplantation with equity” and “act as a national coordinator of all autonomous communities”, collects its website. About Domínguez-Gil, the corporate page emphasizes that the fact that he was “a doctor from Dr. Matesanz’s team [Rafael Matesanz, el fundador de la ONT] It has allowed continuity to the project, continue to grow and continue to be an international reference. ”
