The president of, (-PB), negotiates with the president (), political leaders and ministers of the (Supreme Court) an agreement to find an alternative to the bill that gives amnesty those involved in 2023.

Motta tries to build a consensus between the three powers to reduce pressure on the approval of the proposal, which is defended by the former president (), but seen as an affront to the supreme and possible trigger of an institutional crisis.

PL leader in the House, Gostenes Cavalcante (RJ), said the party already in the House to ask the project to go straight to plenary, but it is up to Motta the decision.

The format of an agreement has not yet been defined, and the mayor has found resistance on various fronts to options such as the reduction of penalties of the convicts. Political leaders seek, mainly, paths within the legislature to end the theme.

One of the alternatives studied is to make adjustments to the Amnesty Bill to predict the reduction of penalties in some cases. Another is to change the legislation on crimes against the Democratic Rule of Law, to reduce minimum penalties and pave the way for a revision of the punishments applied by the Supreme.

It is evaluated, among deputies, to a presidential pardon to resolve the imbroglio. This hypothesis is not good for now in the Planalto Palace.

Hugo Motta talked about the subject with President Lula during a trip to Japan two weeks ago, according to a deputy interlocutor. The theme has also been dealt with with the minister (institutional relations), while Jorge Messias (Attorney General of the Union) addresses the issue with the Supreme.

This Thursday (10), speaking of amnesty or reduction of penalty “compared to some people from January 8,” Gleisi said he was “fully defensible from the point of view of many parliamentarians who are there, perhaps we have to make this discussion even in Congress.” This Friday (11), however, said that any sentence revisions “fit solely and exclusively” to.

Members of the Planalto Palace consider that the discussions are at an early stage and still evaluate what their position should be. The government warned Motta that any solution needs to be right with the Supreme.

The proposal for the agreement was also presented by Motta to Bolsonaro on Wednesday (9). Defendant for the coup plot, the former president said he was contrary to the reduction of penalties and defended the unrestricted amnesty to the accused for the attacks.

Supreme ministers were also sought by Motta to discuss a solution to the pressures that the opposition has made for the vote on the Amnesty Bill. According to two court members heard by Sheetthe conversations intensified on the eve of Bolsonaro’s trial in the first class.

and allied ministers resist the revision of the conviction model. They believe that the progression of sentence of many accused and convicted and even the release of provisional prisoners are sufficient to gradually empty the agenda of amnesty in Congress.

Arrested by January 8 may progress from regime soon because the legislation provides for the granting of the benefit after the compliance with a sixth of the time of imprisonment. In the case of sentenced to 14 years in prison, the right will be purchased from May.

The resistance of ministers considered more politically articulated, such as Moraes and is not unanimous in court. The plenary is divided over the dosimetry of the feathers, and the position of Moraes has a simple majority: 6 of the 11 votes.

Minister Luiz Fux’s nomination that he should change his position on convictions in the most severe cases can further shuffle the scenario in court. In the first class of the Supreme, board responsible for judging part of the cases of January 8, the scenario is more favorable to Moraes.

The mayor has been talking to at least six Supreme Ministers. Dialogues are more frequent with Moraes and Gilmar, according to reports made to Sheet.

Motta arrived with dinner with both ministers a week before Bolsonaro’s trial in the Supreme, at the invitation of Moraes. In a more recent conversation, the mayor warned the duo that he would lead the decision to guide the Amnesty project to the College of Leaders if the PL confirmed the 257 signatures for the urgent request.

With the unfavorable scenario, ministers of the Supreme try to convince that the brief waiting for the progression of the penalties is the best way. In a nod to Motta, Moraes would have decided to change the conduct of some processes.

Since the beginning of the year, the minister had determined the release of only one accused for the attacks. After March 28, he released 15 other people.

The Moraes Movement has dropped to 131 the number of arrested for the attacks of January 8 – if 42 provisional, 84 in definitive prison and 5 in house arrest.

Data show that 8% of those reported by PGR (Attorney General’s Office) are in prison.

There are, in all, 1,586 people accused of crimes against the state. Most (1,099), composed of prisoners in front of the Army Headquarters, was denounced by simple crimes. The convictions of this group are usually a year of imprisonment, with a penalty replaced by community service and obligation to take a course on democracy.

The other part (487) is of people caught in the demonstration that committed more serious crimes, such as coup d’état and deterioration of the overturned heritage. The penalties for this group range from 11 years and 6 months to 17 years and 6 months, depending on the severity of each case.

In this strategy of the Supreme, the release of prisoners and the progression of penalties should be analyzed on a case by case basis, in a way that would be seen as benevolent by Moraes, according to an interlocutor of the minister.

Gilmar Mendes said on Tuesday (8) that the presidents of the House and Senate are aware that there is no environment to discuss amnesty and claimed to defend the appreciation of situations on a case by case basis, not a general sentence review.

Discussions about the January 8 feathers should be resumed in two moments in the Supreme. In one case, Fux released the resumption of the case of Débora Rodrigues dos Santos, the woman she wrote “lost, Mané” in the statue in front of the Supreme. The trial will be restarted on April 25.

On the other hand, Minister André Mendonça asked the plenary to be brought to four defendants’ judgments involved in the attacks of 8 January. The resumption of these cases is not on the April agenda, and it is up to the president of the Supreme Court, Luís Roberto Barroso, to decide the date of the trial.
