Chamber analyzes increasing penalty for crimes against religious entities

Bill creates aggravating factors to protect religious organizations and freedom of worship; Project will be analyzed by the CCJ

O from the deputy (Republicans-DF), alters the Penal Code to protect the heritage from religious organizations and freedom of worship. The proposal is under analysis in the House of Representatives.

The text creates an aggravating factor for crime against those who are watching religious worship. According to the maximum, there must be a more rigorous repression against “The sacrilega fury of temple robbers”.

The theft against heritage of religious organization is classified as a qualified crime, with a penalty of 2 to 8 years of imprisonment, and a fine. Currently, theft has this penalty if it is practiced by two or more people, with destruction, abuse of trust or use of false key.

The theft will also have a high sentence on 1/3 if it is against the equity of these entities. The increase is also valid for:

  • Usurping crimes (increased penalty from 1/6 to 1/3);
  • damage against equity (penalty of 1 to 3 years, and fine);
  • misappropriation (1/3 increase);
  • estelionate against religious organization (1/3 increase);
  • Reception (double penalty).

In the case of usurpation, according to maxim, they would also enter “Shops, milestones or any indicative signs of a dividing line regarding the limits of property of religious organizations, as well as waters, buildings or land that belongs to them”.

Outrage

The proposal increases the crime of outrage to worship, when someone mocks, prevents or disturbs a religious ceremony. The current penalty of 1 month to 1 year of detention is to 6 months to 2 years of detention.

If the crime involves severe bodily injury, the penalty will be 2 to 8 years in prison and fine.

In case of death, the punishment goes to 4 to 12 years and a fine. When the crime has a weapon (real or simulated) or action of two or more people the penalty increases by 1/3.

Next Steps

The proposal will be analyzed by the Constitution and Justice and Citizenship Commission. Then you will go to the plenary. To become law, the proposal needs to be approved by the House and the Senate.
