Proposal of Deputy Geovânia de Sá (PSDB-SC) creates the National Policy of Humanization of Mother and Parental Mourning
The Senate Plenary approved on Tuesday (8.ab.2025) the bill, which ensures rights for women and family members facing a newborn loss of baby or interruption of pregnancy. The project creates the National Policy of Humanization of Maternal and Parental Mourning. From the deputy (PSDB-SC), the proposal was reported by the senator (PT-CE) and now goes to the presidential sanction.
The purpose of the policy is to provide psychosocial support and strengthen care in health services. It ensures more humanized care to families, with wings reserved in hospitals for mourning mothers, specialized psychological support, examinations to investigate the causes of losses and follow -up in the next pregnancy. The project also establishes the specific training of professionals working in maternity hospitals.
According to Augusta Brito, cases of gestational loss, fetal death and neonatal death show the need for a specific policy for mothers and fathers passing through the situation. “The loss of a child during pregnancy or childbirth is a huge pain that affects thousands of Brazilian families”, declared.
Augusta argued that the mourning arising from these losses generates a deep emotional impact and represents a complex and unique process for each individual, which affects not only the mother, but also the partner and family as a whole.

The project ensures the right to burial or cremation of the fetus or born baby, whenever possible with the participation of family members in the elaboration of the ritual. Parents may also request a statement with the name of the stillbirth, date and place of delivery and, if possible, registration of fingerprint and foot.
In addition, hospitals should ensure the right to a companion in the childbirth and social assistance for legal procedures. The measure also establishes that gestational loss, fetal death and neonatal death are not justification for the donation of milk of the mother to be refused, provided that it is evaluated by the head of the human milk bank or collection station.
Union, states and municipalities will have specific responsibilities in the execution of the policy, including the creation of national protocols, the allocation of resources and the development of support strategies for bereaved families. Also according to the project, the month of October should be instituted as the month of gestational, neonatal and children’s mourning in Brazil.
