STF judges requests for suspicion and incompatibility made by the defense of Filipe Martins to remove Moraes, Dino, Zanin and Gonet
The president of the Supreme Court (STF), Luís Roberto Barroso, voted on Monday (14.br.2025) to deny the ministers Alexandre de Moraes, Cristiano Zanin, Flávio Dino and the Attorney General, Paulo Gonet, of the trial on the attempted coup d’état. Voting will Until Tuesday (15.abr).
According to Barroso, the defense of Filipe Martins lost the 5 -day regimental period to file the action requesting the declaration of suspicion, incompetence and incompatibility of the judiciary. This is the vote (PDF 151 – KB).
He claimed that the lawyers were aware of the facts contained in the investigation that investigates the attempted coup of state since August 9, 2024, but only made requests on March 10 this year.
Also stated that, even if filed on time, the requests would not be accepted because “No generic allegations are not allowed, which do not demonstrate the concrete occurrence of situations that compromise the judge’s impartiality ”.
Said the STF from preventing Moraes, Zanin and Dino from participating in the trial in a vote held on the day of receipt of the complaint against the former president (PL) and 7 more accused of integrating the crucial core for the coup.
About Gonet, he said that the appeal is not own to question the attorney’s performance. Reproduced the manifestation of the MPF (Federal Prosecutor) to declare the “Absence of legal reason that justifies the reception of this appeal, including the inadequacy of the procedural way to question the performance of the Attorney General of the Republic”.
Barroso’s vote has so far been accompanied by Minister Edson Fachin. As the plenary consisting of 11 ministers is analyzing the appeal, in a virtual session, there are still 9 magistrates to vote to accompany Barroso’s vote, open divergence or ask for a view.
