The leader of the House, (RJ), wants the (Supreme Court) formally to clarify which crimes attributed to the deputy were committed before and after his diploma as federal deputy in 2022.
On charges of integrating, like the former president (), the central core of a criminal organization that tried to have a coup after (PT) victory in the 2022 presidential elections.
The Supreme Court notified the House to authorize the continuation of the criminal action against the parliamentarian for the crimes committed after his diploma. Parliamentarians, however, are not sure.
With the Supreme’s response, the PT tries to overthrow the PL thesis that the criminal action against branch should be suspended because the crimes would have been committed after he was graduated.
“The request formed now aims to ensure the correct application of the invoked constitutional provision, in order to safeguard the due legislative process, legal certainty and separation between powers, especially in the face of possible coexistence of past conduct and supervening to the diploma of the accused now,” says the petition filed by Lindbergh to the minister on Monday (14).
As a branch is parliamentary, graduated in December 2022, the Constitution provides that the House may suspend criminal proceedings against the parliamentarian for crimes committed after diploma. The decision, however, needs to be made by the house plenary within 45 days after notification.
