The court of denied on Tuesday (15) an extradition request of Oswaldo Eustáquio Filho made by the Brazilian government.
The Spanish authorities considered that extradition request was made for “political motivation”. In addition, the decision recalls that there is no bilateral agreement of the country with Spain that allows extradition in such situations.
The decision is subject to appeal. On other occasions, he has already told Spanish court that he has not committed “any crime” and that he suffers “political persecution.”
The blogger has been in Spain since 2023. In the process that runs in the country, the Brazilian government states that Eustaquio published videos that incited “the practice of undemocratic acts favorable to the closure of the Federal Supreme Court” in 2021.
The Government of Brazil states that Eustáquio used profiles linked to their children to pursue police officers who were investigating attempted coup d’état. The blogger is the supporter of former president ().
Another request had been denied in March. At the time, the Spanish justice understood that the acts attributed to Eustaquio would not constitute a crime in the country. The understanding was that the acts would be protected by the right to freedom of expression.
The acts in question correspond to two crimes in Brazilian law. They are: violent abolition of the democratic rule of law and attempted coup d’état.
For Brazil, Eustáquio is on the run. In addition to the accusations already mentioned, he is also suspected of the crime of alleged use of the daughter’s profile to commit illicit acts.
