Temer defends sentence review in the Supreme Court as an alternative to amnesty for scammers

Former President Michel Temer (MDB) stated that the discussion of amnesty to investigated and convicted of the scammer acts of January 8 is legitimate in Congress, but suggested an alternative: that the Supreme Court (STF) itself reviews the dosimetry of the applied penalties.

For him, this solution would avoid a possible “malaise” between powers and represent a path of institutional conciliation.

“Perhaps, not to create any discomfort with the Supreme Court, it would be best that the Supreme himself would make a new dosage of the penalties. It is a conciliatory solution. What I am proposing is a mediation, a middle ground,” Temer said in an interview with the newspaper The globe.

Nominated by fear of the Supreme, Minister Alexandre de Moraes was praised by the former president, who classified him as a “moderate, sensitive and who knows what to do” magistrate.

According to him, Moraes has already given signs of willingness to review punishments by determining the house arrest of several defendants of undemocratic acts.

Criticism of the broad amnesty

Although he recognizes that Congress has a prerogative to discuss a possible amnesty, Temer has shown concern about the political and legal impact of a broad measure, defended by allies of former President Jair Bolsonaro (PL). The proposal, faces resistance from the mayor, Hugo Motta (Republicans-PB), who evaluates that it is not the time to move forward with the text.

“Punishment happened, there was, but also the penalty should be smaller,” said the former president, suggesting that the STF could modulate the penalties more in a more balanced way.

Case Deborah and Judgment Resumed

Temer also commented on the case of hairdresser Débora Rodrigues dos Santos, convicted of pecking with lipstick the statue of justice during the attacks of January 8.

The trial, which can define one, will be resumed on the 25th in Virtual Plenary. Moraes and Minister Flávio Dino have already voted for the conviction. .
