and thus excludes trans people from that category, it has been celebrated by many sectors of British society as “a victory of common sense” and as a necessary and long -time clarification. For many others, however, the resolution of the magistrates, adopted unanimously, generates new doubts, fears and uncertainties for which there is still no response.
The Human Equality and Rights Commission (EHRC), the independent body that monitors compliance with the laws of equality and non -discrimination throughout the United Kingdom, has announced that it intends to have lists for this summer updated norms of conduct, and according to the sense of the Supreme Court, for all public organizations in the United Kingdom.
Can trans women continue to wear baths or changing rooms only women? Should they go to men? How is the dignity of these people preserved? And the same questions and doubts are for trans men, who would be forced to use women’s facilities.
“We are going to have a new regulatory code of practices, and that assumes that it will become the current law. It will help the future interpretation of the judges. We trust that it is ready for the summer,” Kishwer Falkner, the president of the EHRC, assured BBC.
Falkner, who takes five years in charge of the agency, and has insistently claimed the government and public bodies that establish clear norms. He has received a lot of support, but also his part of criticism and hate messages, through social networks, which this debate has been generating for years.
“It is a victory of common sense,” Falkner said in reference to the Supreme Judgment. “But only if you also recognize that trans people exist and have rights. And those rights must be respected. Only in this way it becomes a victory of common sense, and not a victory that serves to increase the number of unpleasant actions committed against trans people. We will not tolerate that, because we remain firm in their defense,” he wanted to emphasize the president of the EHRC.
Medical Pavilions for Women
But at the same time, Falkner has made it clear that the commission that changes its internal rules regarding the treatment of trans people. So far, the recommendations of the NHS that allow the entry of trans women into certain pavilions or wings destined for women are still valid. The health network indicates in its internal regulations that trans people must be accommodated in accordance with the way they dress, their names or pronouns they use to identify. In English, many people claim that pronouns are used They/them/thier (They) instead of male pronouns he or her To address them. It is an alternative similar to elle They claim in Spanish.
Some problems, such as the use of bathrooms or changing rooms, can try to be solved with the existence of a third neutral gender space, Falkner said, which has suggested trans organizations that press to be incorporated. But others present greater complications, such as residences for women who have suffered domestic abuse (the term with which much of gender violence is still called in the United Kingdom) or prisons.
Sports competitions
The judgment of the Supreme of the United Kingdom also refers to extends its exclusion of trans women to “activities defined by gender”, in which “physical strength, resistance or average physical structure of people of a certain sex would place them in a disadvantage situation with respect to people of another sex.”
But the court resorts to an example that fits as a glove to its definition, boxing,
British federations such as cycling or athletics have already decided on their own transfers from the competition.
The labor government of Prime Minister Keir Starmer has tried to respond to the supreme judgment in the most pragmatic way, to avoid “the so -called cultural wars” derived from such a thorny debate. “We are going to study the sentence, to ensure that we fully comply with it,” said the Secretary of Health, Karin Smyth. “I think the time has come to look to the future, that the rights of all people are clear, and that organisms that offer public services ensure that they comply with the law,” he added.
