An investigation against the government of disrespect and contempt for him to launch a federal judge, as he describes in 46 -page opinion, it appears that he “deliberately ignored” his decision on March 15, banning the 18th century by law.
“The court concludes that, by its actions that day, the government deliberately ignored its ruling,” Judge James Bosberg said, finding that there was a “reasonable reason” to accuse the tycoon’s government.
In the middle of last month, Bosberg banned the government from deporting immigrants – exclusively – the law of 1798 on “foreign enemies”. At that time, more than 200 people, whom the government presents as members of a Venezuelan gang, were on the way to El Salvador, without a court ruling to deport them. When the judge’s ruling was issued, two planes with immigrants were already headed to El Salvador and did not return to the US but permission.
Bosberg said today that there is a “reasonable reason” to judge that the government has shown contempt for the court. “The court does not come to this conclusion frivolous or hurriedly. Indeed, the defendants have given many opportunities to correct or explain their actions. None of their answers were satisfactory, ”he writes in his rationale.
On the basis of the ruling, the government official, who ignored the judicial order, may be prosecuted.
The judge, however, noted that the government would be given a new opportunity to remedy before examining the prosecution. As he said, the “most obvious” way is to allow immigrants deported in violation of his order to appeal to the courts to challenge her ruling. Bosberg stressed that to do so, immigrants do not need to return to the US and the government could propose “other ways to comply”.
The Trump government did not immediately respond to a request for a comment.
