CNJ departs from Judge who associated Lula with Comando Vermelho

The Plenary of the National Council of Justice (CNJ) dismissed Judge Marcelo Lima Buhatem for 60 days, from the Rio de Janeiro Court of Justice (TJ-RJ), by publication of messages of political-partisan political in social networks.

The CNJ states that the judge published, in March 2023, on his profile at Linkedin, messages that questioned the credibility of the Brazilian judicial and electoral system. For the agency, the posts “fostered social distrust in justice, security and transparency of elections.”

The disciplinary offenses were reported by Counselor Alexandre Teixeira. In his report, Teixeira voted for the penalty of availability for 90 days. Most of the plenary, however, followed the divergent vote presented by Caputo Bastos counselor.

In addition to the publications, the judge responded for alleged breach of impartiality, stoppage proceedings in his office and absence of declaration of the judge regarding his suspicion in relation to the lawyer acting in the TJ-RJ, with which he had kinship bond.

Lula Association with Red Command

In 2023, the National Corregedor of Justice, Luis Felipe Salomão, determined inspection in the office of the Judge of Buhatem for critical publications to President Luiz Inacio Lula da Silva (PT) and favorable to former President Jair Bolsonaro (PL).

According to the CNJ, before the second round of the 2022 elections, the judge would have shared fake news about Lula with a message that he was a “red command guest of honor”, ​​on his visit to the German complex.
