They also argue that the camera algorithms that identify possible criminals have flaws and are not “trained” with faces of blacks, women and trans people, which can generate errors.
“Most of these algorithms have been trained to recognize faces from databases where there are no racialized people, and not even women, or trans representative people, resulting in greater difficulty to create an accurate facial signature for these populations,” the action says.
The action cites three cases of misconceptions released by the press, such as the case of a Tiradentes city gardener who was arrested 10 hours in December 2024, confused with a sought by the court.
“Facial recognition technology violates fundamental rights, is especially discriminatory with black and transgender people and violates privacy,” says the representation.
Collective mandates ask the Civil Police to establish civil inquiry to “investigate the human and fundamental violations of citizens” as a result of errors in the program and advertise for possible misconceptions.
The City of São Paulo rules out the occurrence of errors and says that the identification of individuals through cameras only occurs with certainty above 90%.
