Originally, the lawsuit was opened against the PSL, a party that at the time sheltered then -President Jair Bolsonaro (today in the PL). União Brasil inherited the process, as it was created from the fusion of the PSL with the Democrats in 2021.
To the court, the actor said he was hired by an agency to participate in an advertising campaign about. To his surprise, however, his image was used to release an advertisement whose goal was to attract new affiliates to the party.
“He was wrong,” lawyer Ricardo Moares da Silva, who represents the actor, told court.
The judges stated in the decision that text messages attached to the case proved that it had been called to a new pension campaign and condemned the party, EMS Productions and FSB Comunicação, companies involved, respectively, in the selection of actors and in the recording of the advertising piece.
“There is no way to exempt the political party from responsibility because, receiving the video, it disclosed it to the general public, without the caution that all actors had given their authorization to use image,” said Judge Jane Franco Martins in the decision. The party and companies can still appeal.
União Brasil said in the process that it never made any deal of deal with the author of the process and that, if there was manipulation, it did not occur for its responsibility. He said he merely hired the FSB for the execution of the advertising campaign and that this company must be responsible for any damage caused.
The FSB told the court that it had subcontracted EMS productions to make the selection and instruction of the actors, and it was not to blame for the incident. “FSB at no time remained contact with Caio or any of the other actors hired for the advertising campaign,” he said in the action.
EMS Produções, in turn, told court that the actor’s allegations are disconnected from the truth, and that he tries to get rich illegally. He stated that Caio was fully aware of the content of the video that would be recorded.
“All actors received the term before the recordings, which contained express information that it was the ‘PSL’ campaign.”
The judge rejected the argument by stating that this document does not prove that the actor was unmistakable that it was a political campaign, as the producer repeatedly claimed that the recording would be for social security.
