The minister, granted house arrest to the indigenous Paraense Helielton dos Santos, who had been arrested since September 2023, accused of participation in undemocratic acts.
The decision of 13 April establishes a series of precautionary measures, such as anklet use, prohibition of use of social networks, communicating with others involved, giving interviews and receiving visits, except from nearby family members and people authorized by Moraes.
Helielton is accused of committing crimes such as qualified damage, major fire, criminal association, violent abolition of the Democratic Rule of Law and coup. Their acts were prior to the attacks of January 8.
He would be part of the group linked to the evangelical and indigenous pastor, known as Cacique Tserere, arrested after promoting attacks in December 2022 and attempted invasion of the PF headquarters in Brasilia.
“The presentation of the conclusive report of investigations and the circumstances of the case show that the precautionary segregation is no longer justified, either for the guarantee of public order or for the convenience of criminal instruction, since there is no present possibility of reiteration of the crime and the risk of interference in probative production,” says the decision of the minister.

Helielton’s release comes in the wake of other Moraes decisions that make previous measures more flexible as to reduce penalties to the convicted by undemocratic acts.
