The employer and the main unions of the construction sector, which it employ in Spain, has just agreed to include a protocol against discrimination of the LGTBI+ collective in its collective agreement. As confirmed in the main employer, the National Confederation of Construction (CNC), have reached a pact with the most representative unions, CC OO of the Habitat and UGT FICA, to take “a decisive step in the defense of the rights of the LGTBI collective”. These types of protocols derive from one, by which the agreements must collect concrete measures to ensure equal treatment and non -discrimination of this group.
According to CNC, two annexes have been incorporated that collect both the agreed measures to achieve real and effective equality of LGTBI+ people and a specific protocol of action against harassment and violence towards this group. The text has not yet reached the Official State Gazettebut in the employer they specify that this step will materialize in the next few days.
“The social agents consider it essential to adapt the disciplinary regime of the agreement, incorporating new assumptions of infraction that guarantee the effective fulfillment of the principles of equality and non -discrimination. These measures translate into the inclusion of clauses that reinforce equity in key aspects of working life, such as access to employment, classification and professional promotion, training, awareness, use of inclusive language, permits and benefits social, ”adds the CNC.
All companies in the sector that have more than 50 workers in their workforce must comply with this new regulations. And the employer also recalls that these measures “also reach those applicants who request a job, to the provision, suppliers, customers and visits to companies.”
“With this agreement, the construction sector demonstrates its commitment to the LGTB collective, placing the avant -garde of the defense of rights of this group and putting all the tools at your disposal against discrimination and violence,” adds the CNC.

The set of measures is based on: it establishes that collective agreements must contemplate specific clauses of equal treatment and non -discrimination for people LGTBI+; It points out that companies must teach to avoid discrimination of the collective in interviews and promotions; sets the inclusion of a protocol against harassment and violence; that “the” templates heterogeneity to achieve diverse work environments “will be promoted”; and contemplates specific measures to promote the integration of the trans group, the one that suffers the most labor discrimination.
CEOE, Cepyme, CC OO and UGT agreed with the Ministry of Labor, which must be developed mandatory in companies with more than 50 employees, but can apply to many others of smaller size, since it must move to all agreements, such as the construction general.
The groups that represent the LGTBI+collective, many companies are dragging their feet in the implementation of this type of protocols. On January 8, the deadline for negotiations within each agreement ended and the marked deadline for those conversations to be resolved ended. If the agreement has not been reached, the companies are also obliged to implement a series of minimum measures contemplated in the Royal Decree. Companies that do not comply face possible inspection sanctions.

As recently explained by a spokesman for the State Federation of Lesbians, GAIS, trans, bisexual, intersex and more (Felgtbi+), this political scenario “reinforces the importance of laws and the rule of law against the volatility of markets.”
Felgbti+ demanded that the Ministry of Labor monitor compliance with this new regulations and added a message: “We remind the minister of their public commitment to also approve an accompaniment protocol for the labor insertion of trans people.
