The 14 defendants will be responsible for five crimes: attempted abolition of the Democratic Rule of Law, coup, armed criminal organization, qualified damage and deterioration of listed heritage.

On Tuesday, Moraes once again presented a video showing the attacks of January 8 and asked the “people of good faith” to reflect on amnesty requests to those involved in the coup attacks, questioning whether they would authorize a destruction such as the three powers in their homes.

All involved were made defendants by the Supreme unanimously, despite divergences from Luiz Fux about whether the cases should be processed in the first class or in the plenary.

ACTION MANAGEMENT

The second slice involved accused of managing operations to realize the coup d’état, even planning to murder Lula and Moraes, as well as the vice president ().

The accused would also have operated on an attempt to prevent voters from the petista from voting in the second round of 2022.

Unlike what happened in the trial of the first core, which lasted two days, this time there was less debate among the ministers about the terms of the accusations. After Moraes concluded his vote in the afternoon, the other magistrates endorsed their position in a few minutes.

Next Steps

With the complaint considered admissible by the Court, the progress of the criminal proceedings itself begins-before, there was only the investigation phase, carried out by PGR and the.

The first stage is the instruction, when more evidence and new testimonials are collected, nominated by both prosecution and defense, they are performed. Then the first class of the Court will decide on conviction or acquittal. This should happen by the end of this year to prevent the decision from taking place in an election year.

In the end, the parties may submit resources to the decision. The planned penalties reach over 40 years of imprisonment, excluding possible aggravating fans in the trial.
