The magistrate of the Supreme Court Ángel Hurtado, has already received a response from both Google and WhatsApp about the request he made to try to recover the content of the mobile phone of Álvaro García Ortiz, erased by this after being prosecuted. After this Wednesday the judge opened a separate piece and commissioned to the Civil Guard to analyze the documentation sent by the Irish authorities, to which Hurtado sent a rogatory commission to request the information to both companies, the instructor has issued this Thursday another car to decree the same about new documentation sent by the United States, a country to which the request related to WhatsApp that this request should be processed through the US authorities.
The intention of Hurtado when requesting the collaboration of both companies is to recover the information sent and received by the telephone numbers of the Attorney General between March 8 and 14, 2024, in which he admitted that his client had committed two fiscal crimes and offered the Prosecutor’s Office a pact that would fought him from the prison. Legal sources point out that the magistrate has not yet accessed the folders with the information sent by the two companies, but the mere fact that they have responded to their request and have submitted documentation already considers it a success, given the doubts that were in that Google and WhatsApp went to attend their request.
As explained by the instructor in the order issued on Thursday, the United States response was received yesterday through the Ministry of Justice and consists of two Zip folders, to which two writings accompany, one of them in English. The judge commissioned the Central Operating Unit (UCO) of the Civil Guard to analyze the information, as already established that it should be done in “case it was successful, as it seems to have been, the Rogatory Commission released”, says the instructor, thus repeating the same expression he used in the car to refer to the answer sent by Ireland.
“Once completed, documentary information may have been collected, which requires your expert exam,” says Hurtado. The judge opens a separate piece on the documentation sent by the United States and declares it secret for a month, but orders the UC to inform him “with a periodicity that does not exceed five days” of the progress of the expert analysis and the result that is obtaining.
