Alberto González Amador has judicially defeated the Madrid City Council in the case of the works of the attic where he lives with his partner, President Isabel Díaz Ayuso. The judgment of the Contentious Court number 14 of Madrid is dated March 7 and became firm a month later. The ruling has been advanced this Friday for him the country has already had access. The municipal legal services have not resorted to the resolution, unlike in many lawsuits that lose in the contentious-administrative, the judicial route to resolve controversies between citizens and the administration. The sentence also condemns the Consistory in coasts, without specifying the figure.
The case dates back to August 2022 when Amador initiated a reform on the floor he bought in the Chamberí district, after committing an alleged fiscal fraud of 350,910 euros. As it is mandatory, he informed the City of demolition to the City Council through a responsible statement, but the City Council ordered the stoppage, because the businessman had informed them that he would subsequently expand that document. The Consistory informed him that it is not possible to extend responsible statements. However, Amador sent that second document and the Administration responded with a new paralysis order that repeated an identical text that had used in its first cessation resolution. The judge has concluded that Amador was legitimized to do the work because the City Council did not refer to that second declaration of Amador.
In addition, the judge has determined that the City Council is wrong to consider that the responsible statements cannot be extended, because that option is contemplated in the Autonomous Land Law.
