The Supreme Court Minister (STF), Alexandre de Moraes, decreed the arrest of former President Fernando Collor de Mello after rejecting, on Thursday (24), appeals against the conviction in one of.
With the decision, the former president is subject to a penalty of 8 years and 10 months in prison, with the beginning of compliance already determined by Moraes. The order is in force and can be performed at any time.
At the request of Moraes, the president of the Supreme Court, Minister Luís Roberto Barroso, scheduled a session in the virtual plenary for the court ministers to review the individual decision. The analysis is scheduled for 11am this Friday (25) and runs until 23h59 of the same day. Meanwhile, the arrest order is still in force.
In May 2023, the Supreme Court sentenced the former senator and former president to 8 years and 10 months in prison for passive corruption and money laundering in one of Lava Jato’s cases. Despite the decision, Collor can appeal in freedom.
After seven consecutive sessions of judgment, the Court defined the penalty based on the vote of the reviewer of the criminal action, Minister Alexandre de Moraes. The rapporteur, Minister Edson Fachin, had defended a penalty of 33 years and 10 months in prison, but was overcome in the vote.

In 2023, former President Fernando Collor was sentenced by the Federal Supreme Court to 8 years and 10 months in prison for corruption and money laundering. According to the prosecutor, he received R $ 29.9 million in bribes between 2010 and 2014, in a scheme linked to irregular contracts of BR Distribuidora, subsidiary of Petrobras, in the sale of fuels.
The bribe would have made possible agreements with UTC Engenharia for the construction of distribution bases. In addition to Collor, businessmen Luis Pereira Duarte de Amorim and Pedro Paulo Bergamaschi de Leoni Ramos were also convicted.
