Minister Alexandre de Moraes of the Federal Supreme Court (STF) determined on Friday (25) that former President Fernando Collor de Mello begins the fulfillment of his eight years and ten months in closed regime, in the Baldomero Cavalcanti de Oliveira prison in Maceió (AL).
The decision was made after Collor passed a custody hearing and takes into account his condition as former President of the Republic. Moraes ordered him to remain in a separate cell in the special wing of the prison unit, and established a period of 24 hours for the prison to report if he has a full conditions to ensure the necessary medical care for the detainee.
Earlier, Collor’s defense requested the conversion of prison to the home regime, alleging health problems such as Parkinson’s disease, severe sleep apnea and bipolar affective disorder – conditions that, according to lawyers, require constant medical monitoring and specialized care. However, Moraes determined that the Attorney General’s Office (PGR) manifests itself before any eventual granting of the request.
STF will still judge prison
The immediate execution of the sentence was determined on Thursday night (24), after Moraes rejected the last possible resource of the defense and consider embargoes as delayes.
In the Virtual Plenary of the Supreme Court, the rapporteur was accompanied by ministers Flávio Dino, Edson Fachin and the president of the Court, Luis Roberto Barroso. However, the analysis was suspended after one, which transferred the discussion to the physical plenary – yet not scheduled. Nevertheless, the arrest warrant remains valid until new deliberation.
