The minister, (STF), voted on Friday (25), to condemn the hairdresser Débora Rodrigues dos Santos, but to a penalty of 1 year and six months. With the vote, there is a majority for the conviction, but the size of the penalty remains undefined. Fux had already signaled that he would open divergence because he considered the dosimetry proposed by Alexandre de Moraes (rapporteur), who voted to condemn Deborah to 14 years in prison in closed initial regime. The minister considered that there is no evidence of Deborah’s participation in the breaking break. “There is only proof of individual and isolated conduct from the defendant, in the sense of pending the statue of justice using a lipstick,” wrote Fux.
Deborah is under house arrest with anklet, after spending two years pre -tried in the Rio Claro Women’s Penitentiary in São Paulo, since the eighth phase of Operation Lesa Fatherland, triggered by the Federal Police in March 2023. The operation investigated radicals and funders of vandalism acts. If Fux’s sentence proposal prevails, she will not have more prison time to serve, because the time she has been preemptively arrested in the process is deducted from the final sentence.
In testimony, the hairdresser confirmed that it vandalized the sculpture with red lipstick. She stated that she acted in the “heat of the moment” after a man asked her to finish writing the phrase in the monument. He also said he did not know the statue’s symbolic and financial value. The phrase “Lost, Mané” is a reference to the response that Minister Luis Roberto Barroso, president of the Supreme Court, gave a scholarshiprist who approached him in New York contesting the defeat of former President Jair Bolsonaro (PL) in the 2022 elections.
