Decree of 2008 assures those who held the Presidency of the Republic, Security, Drivers and Support Team, even after leaving office
The former President of the Republic, arrested on Friday (25.abr.br.2025) in Maceió (AL) for crimes of passive corruption, money laundering and criminal association, follows with access to lifetime benefits guaranteed by Decree 6.381 of 2008. Read A (PDF-290 KB)
According to the decree, former presidents are entitled to the use of:
- Services of 4 servers for security and personal support activities;
- 2 official vehicles, with their drivers; and
- Advisory of 2 servers.
The standard does not determine salary payment or any type of lifetime retirement. The 1988 Constitution extinguished this type of benefit to former presidents.

The Supreme Court Minister Alexandre de Moraes determined on Thursday (24.br.2025) the arrest of the former President of the Republic Fernando Collor de Mello, sentenced to 8 years and 10 months.
Fernando Collor was convicted in 2023 for corruption in a lawsuit that derived from Operation Lava Jato. He was reported in 2015 by the PGR (Attorney General’s Office) to the STF, who began a criminal action against the then senator by Alagoas. Collor left Congress in 2022, when he was not elected.
The arrest has been 33 years after the former executive chief suffered an impeachment process for an influence trafficking scheme during his government, and corruption in family home reforms in Brasilia.
The complaint accused Collor of receiving a bribe of R $ 20 million to favor UTC Engenharia in contracts with BR Distribuidora (today Vibra Energia), a subsidiary of Petrobras. In addition, the former president would have influenced the nominations to the board of the fuel distributor. Payments were made from 2010 to 2014.
Collor’s lawyers said he was arrested around 4 am, hours after the Order of Moraes. He was heading to Brasilia to present himself to justice spontaneously at the time of prison.
