STF President says that Congress -issued legislation was applied to the trials and declares not to call charges
The president of (Supreme Federal Court), Minister Roberto Barroso, said he did not agree with the possibility of amnestying those involved in the extremist acts of January 8 because, according to him, “Amnesty is forgiveness, and what happened is unforgivable.” However, he stated that Congress has the right to resize the extent of the penalties, as it is “Within its competence”.
“The Supreme applied the law -edited legislation on the January 8 judgments. The solution to those who think the penalties were excessive is a change in the law. I don’t think it’s the case of amnesty, because amnesty means forgiveness. And what happened is unforgivable. But resizing the extent of the penalties, if Congress understands well, is within its competence.”said Barroso, in an interview with Globopublished this Sunday (27.br.2025).
Barroso said he still did not care about the pressure on the Supreme to reevaluate the penalties of those involved. About the Amnesty Project in the House of Representatives, he stated that he was open to dialogue with the mayor (Republicans-PB), but stressed that the issue has not yet been discussed by them.
“In most lawsuits (January 8), the conviction has not yet happened […] What I have heard, which is a feeling in some segments, is that the feathers are heavy. Therefore, if the idea is to have lighter penalties, it is the case of modifying the legislation ”these.
To avoid the coincidence between the judgment of those involved and the electoral period, Barroso indicated that the ideal would be to finalize decisions in 2025. He said it was necessary to hear witnesses, gather evidence and evaluate the possibility of making the trial later this year.
Asked about the possibility of the House to make proposals against the Supreme, Barroso contested the idea and said that Casa Baixa is “Fulfilling your role” to be a “Resonance box of society’s concerns”.
Our relationships with Congress are the best possible. But that does not necessarily mean agreement in everything. What worries me is extremism, undemocratic action. Congress, which has already suffered from a dictatorship, knows the importance of playing according to the rules ”, stated.
