The (National Union of National Regulatory Agencies) sent a letter to (National Civil Aviation Agency) contesting the selection process for the position of Air Navigation Commissioner of OACI (International Civil Aviation Organization) for restricting wide competition.
The letter is dated last Friday (25) and proposes the review of the announcement published on April 17 by the agency to fill the position. To compete, it would be necessary to occupy or occupy director positions (including substitutes), superintendent (including substitutes) or manager, considering nominations from 2015.
The union qualifies the criteria as excessively restrictive and argues that the notice does not have an objective justification for limiting positions or for the choice of 2015, “generating evident arbitrariness”.
“The announcement, by establishing eligibility criteria that make it difficult for certain interested parties to participate, has unduly restricted to wide competition,” says Sinagencies, which adds that the selection process should choose the most capable candidate for office, “regardless of having occupied specific management functions since a particular year.”
The union also states that the requirement is not supported by normative instruction of 2021.
Sought, ANAC reported that the occupant of the position of Air Navigation Commissioner will represent the Brazilian State in technical and strategic discussions on the subject in OACI.
The agency states that participation in the entity requires not only specialized knowledge, but also capacity for multilateral articulation, refined diplomatic posture, technical domain and strategic performance on topics of global interest. The selected, he goes on, will participate directly in the formulation of international operational safety standards in an environment of high technical complexity and diplomatic sensitivity.
“Functional seniority is, in this sense, an indispensable qualification criterion to occupy the function,” he says.
The agency says the process was rigorously structured to prioritize the selection of the most qualified and prepared candidate, “at risk of compromising Brazil’s reputation in the world scenario, as well as the ability to defend national interests in international forums.”
ANAC states that experience in leadership activities from 2015 stems from the “need for recent regulatory experience and aligned with the current institutional and normative context of international civil aviation.”
According to Anac, the announcement was prepared in accordance with the 2021 instruction and the formal justification was made through the preparation of a technical note.
