Minister Gilmar Mendes, dean of the Supreme Court (STF), denied on Monday, 28, that the arrest of former President Fernando Collor de Mello is a precedent or a “sign” of the Court to former President Jair Bolsonaro (PL), who responds to a criminal case on the Supreme Court on charges of plotting a coup d’état.
Collor was arrested at dawn last Friday, 25, to serve the sentence of 8 years and six months for corruption in a lawsuit derived from Operation Lava Jato.
“I don’t see it like that. I think each case has its peculiarities and its singularities. I don’t think we should take any other conclusion from here,” he said after being questioned by journalists at the exit of a lecture organized by the São Paulo Lawyers Institute (IASP).
The minister also admitted that he gave up the prominent request in the trial of Collor’s arrest because the other ministers anticipated his votes and formed a majority to keep him in prison.
Gilmar also explained that he took into account the request for house arrest filed by the defense of the former president, who is under analysis of Minister Alexandre de Moraes.
“There were already votes in this regard in the virtual plenary and there is also a house arrest request that is being deliberated by Minister Alexandre. So let’s wait for these developments,” said the minister.

The arrest warrant came from Minister Alexandre de Moraes, who determined the execution of the sentence for considering that there are no more possible appeals to reverse the conviction of the former president and that defense claims are now just “delayers”.
The individual decision was immediately submitted to the sieve of other ministers in an extraordinary session in the Virtual Plenary of the Supreme Court on Friday. The vote, however, was interrupted at the request of Gilmar Mendes, who considered that the case should be analyzed in a face -to -face session given the political repercussion.
Gilmar presented the so -called “prominent request”, which is a prerogative of all STF ministers. With this, the trial is resumed from the beginning in the physical plenary and the ministers who eventually voted in the virtual session have to position themselves again.
