Senate government leader Jaques Wagner (PT-BA) stated favorable to a project that proposes the reduction in the penalties of the condemned acts of 8 January, as long as it does not contemplate amnesty to the principals and financiers.

“I think it’s great as long as it is not mentioned amnesty for the principals and financiers of the crime. And I’m not referring to [ex-presidente Jair] Bolsonaro [PL]which is already ineligible and, for me, can be a candidate, because it does not bother me, ”said the senator in an interview with S.Paulo Folha.

Wagner commented on the proposal articulated by the presidents of the Legislative Houses, Davi Alcolumbre (União Brasil-AP) and Arthur Lira (PP-AL), with the support of Deputy Hugo Motta (Republicans-PB), which aims to reduce penalties for those convicted of vandalism and invasion of the buildings of the three powers.

The project is considered a strategy to discredit the relationship between Congress and the Federal Supreme Court (STF), as well as seek to contain the advance of the controversial amnesty project that is being discussed among Bolsonarist parliamentarians.

“The Plateau is not leading this subject. The position – which I would claim to be who watches for democracy, rather than the Plateau itself – is not to agree with an amnesty. Who is under pressure is Parliament, to vote this agenda. And this vote is a way of confronting the STF, not the plateau.

It is expected to be presented by David Alcolumbre in May. The measure provides for the reclassification of penalties for crimes considered less serious, such as the depredation of public assets, allowing the compliance under home or even the release of already sentenced prisoners.

The changes would have retroactive effect and could benefit those involved in the acts of 8 January who did not play leadership roles.

According to sources of Congress, the proposal would have already received a green light from STF ministers, such as Alexandre de Moraes and Roberto Barroso. The intention is to prevent an eventual approval of a broad amnesty from benefiting also former President Jair Bolsonaro and other scammers’ articulators.
