Minister says platforms must have “limits”; criticizes model that, according to him, profits from misinformation
STF Minister Edson Fachin criticized the lack of “Limits” of social networking platforms and stated that Congress needs to discuss regulation. The statement was made during a forum promoted by the newspaper The State of S. Pauloon the 3rd (29.abr.2025).
“The National Congress is now challenged to discuss the regulation of such platforms and, consequently, to create legitimate mechanisms for democratic containment of the harmful impacts of fake news,” said the minister.
According to Fachin, it is possible to develop “Legitimate mechanisms of democratic containment” against the dissemination of misinformation. Last year, a set of actions dealing with the responsibility of digital platforms about the contents published therein.
The trial was interrupted after Minister André Mendonça request more time for analysis. In previous years, the Supreme has chosen to postpone the analysis of the theme in deference to the National Congress. However, in the face of the lack of legislative advances in the regulation of social networks, the Court decided to resume the process.
Fachin also argued that there is currently a business model that benefits from the absence of rules. “I understand that there are no freedom without democratic limits, no freedoms without legitimate responsibilities. There is a new public sphere, where a business model that has profited with this state of affairs and the defense of all freedoms-even without any limit, not even to protect their own freedom“He concluded.
