For opposite reasons, members of the opposition and a Lula government (PT) wing (PT) presented objections to the construction of one applicable to the participants of the undemocratic acts of 8 January, but without a forgiveness for the crimes committed.

The alternative proposal to is sewn behind the scenes by the presidents of the Senate, (-AP), and da, Hugo Motta (Republicans-PB), with the Supreme Court (STF).

While senators and federal opposition deputies publicly condemned the suggestion and promised not to give up a broad amnesty, President Lula assistants even claimed that this agreement would be unconstitutional, for injuring the autonomy of powers.

The theme was debated by the main opposition senators on Tuesday (29) during lunch. According to reports, parliamentarians said they had not been consulted by alcoholumbre on the idea and defined that it is necessary to insist publicly in amnesty.

Senators Flávio Bolsonaro (-RJ), (PL-RN), (PP-PI), (Republicans-RS), Carlos Portinho (PL-RJ), (Republicans-DF) and Eduardo Girão (Novo-CE) were present.

PL leader, Portinho dubbed the “Rome Agreement” proposal – in irony of Alcolumbre and Motta’s trip to Pope Francis’ wake over the weekend with President Lula and the president of the Supreme, Luis Roberto Barroso.

“This pact of Rome has not been debated with the leaders, so one cannot speak of Congress proposal. If there is any certainty, it is that the presidents of the House and, if they are talking to the Supreme Court, it is because they agree that the penalties exorbitated,” he says.

In the same line, Marinho states that the opposition will reiterate the amnesty request regardless of alcohumbre proposal. “You think Parliament is normal discussing a project and that the judiciary decides how this project will take place? How do you make a selective amnesty? I will forgive this and penalize that?” What is the criterion? “

The proposal suggested by the Senate President, as the Sheet. One, subordinate to alcohumbre. The text has not yet been released.

The proposal of the pockets provides for amnesty to all past and future acts linked to attacks on the headquarters of the three powers. A, PL now studies a new version of the text of the text, which possibly restricts forgiveness to the convicts.

Former Bolsonaro’s vice, Mourão says any alternative is “out of purpose.” “There are a number of legal errors in this whole process and we have come to the conclusion for some time that the only way to correct this is through amnesty,” he says.

On the other hand, a part of the opposition reserves that there is room to support a project that benefits at least some of the convicts. Two parliamentarians who did not want to identify said that it is a better amnesty to no amnesty and that it will be difficult for opposition to vote against the reduction of penalties, even if not ideal.

The discussion dominated the Senate plenary session. At the end of the day, Marinho, Portinho and Flavio issued a note in which they ask for “amnesty already”.

Rapporteur of the project in the House, Deputy Rodrigo Valadares (União Brasil-SE) said he has seen several alternative minutes and will only deepen when the text is actually disclosed. The fear, he said, is that the issue is under behind -the -scenes debate to serve as an argument to empty the pressure on the parties to be voted in plenary.

An amnesty protest is scheduled for Wednesday (7), to maintain the mobilization around the project. The group wants to convince Motta to vote the urgent request for the project.

In the evaluation of a Lula interlocutor, the discussion of a project should not even be done in the course of a trial and the evaluation of the penalty would be up to the Supreme Court. The agreement could hurt the autonomy of powers, in the evaluation of this ally. Congress cannot judge, nor the STF legislate, he says.

Petistas also speak of opening a process that could culminate in the acquittal of coup leaders and even the eligibility of Bolsonaro.

Another wing of the government states, however, that the correctness could distens the relationship between Parliament and Judiciary, although the executive from the debate is excluded.

“I think the debate will be well accepted. It is the extended hand for national conciliation,” says the government leader in Congress, Senator Randolfe Rodrigues (PT-AP).

For Deputy Jilmar Tatto (SP), who is PT’s national secretary of communication, the proposal is useful for reducing pressure for a broad amnesty. “It was good to put this debate about the Penal Code because it dehydrates the issue of amnesty and penalizes those who have the most responsibility, that organized and funded the coup,” says the petista.
