Moraes sends PGR to comment on Collor’s house arrest

Deadline to respond to the STF is 5 days; Former president is arrested in Maceió, but alleges advanced age and serious comorbidities

The Minister of (Supreme Federal Court) Alexandre de Moraes sent on Wednesday (30.br.2025) the request for house arrest of former President Fernando Collor to the PGR (Attorney General’s Office) to analyze. The response period is 5 days, as usual.

“Overplide the Attorney General’s Office for manifestation as to the request for humanitarian house arrest, within 5 (cinco) dias”wrote the minister.

The former president of a decision on a humanitarian household arrest, as he is 75 years old and serious comorbidities such as Parkinson, serious sleep apnea to bipolar affective disorder. He has been arrested since last Friday (25.abr) in the Special Wing of, in Maceió (AL).

The arrest warrant was confirmed by the majority of the Supreme Court on Monday (28.abr). By 6 votes to 4, the ministers rejected the defense appeal to review the feather’s dosimetry and keep the former president. Collor was convicted in 2023 to 8 years and 10 months in prison for corruption and money laundering for deviations at BR Distribuidora. The process derives from Operation Lava Jato.

Collor’s defense asked the penalty to be served at home. In a custody hearing, however, the politician denied that he had any disease or continuously use medicine. Moraes then allowed lawyers to protocol medical reports and examinations that prove the health condition of the former president. The documents were presented, but are under confidential, by determination of the minister.

In the decision that had Collor arrested, the magistrate also asked the prison unit to inform whether it is able to offer adequate health treatment to the former president. The prison confirmed that it is possible to deal with the politician.

The (Supreme Federal Court) on Monday (28.abr) 6-4 maintain the arrest of former President Fernando Collor-consistent with 8 years and 10 months in prison for crimes of passive corruption, money laundering and criminal association.

CONVICTION

Former President Fernando Collor, 75, was convicted in 2023 for corruption in a lawsuit that derived from Operation Lava Jato. He was denounced in 2015 by the PGR (Attorney General’s Office) to the STF, who began a criminal action against the then senator by Alagoas. Collor left Congress in 2022, when he was not elected.

The arrest warrant is 33 years after the former executive chief suffered an impeachment process in 1992 for an influence trafficking scheme during his government and corruption in family home reforms in Brasilia.

The complaint accused Collor of receiving a bribe of R $ 20 million to favor UTC Engenharia in contracts with BR Distribuidora (today Vibra Energia), a subsidiary of Petrobras. In addition, the former president would have influenced the nominations to the board of the fuel distributor. Payments were made from 2010 to 2014.
