Alfredo Gaspar states that parliamentary immunity must be maintained in the case; Party says Bolsonaro can benefit
The deputy (União Brasil-AL), rapporteur of the (liberal party) who asks for the annulment of the case against the deputy in the Supreme Court (Supreme Court), voted for approval of the subtitle request this Wednesday (30.br.2025).
Ally of the former president (PL), Gaspar states that parliamentary immunity should be maintained for branch in the case. This is the rapporteur (PDF – 192kb).
Ramage is defendant in the same case as the former president (PL). The party’s appeal at Casa Baixa would also serve to suspend the action against the Executive’s former Mandant-besides benefiting the congressman.
If the PL application is approved by the CCJ and then in the House, Ramagem will no longer be responsible for crimes such as qualified damage and deterioration of listed assets – both related to the January 8 extremist acts.
STF Minister Cristiano Zanin, however, that Ramagem would continue to respond for the alleged coup plot so he took place before his inauguration as a federal deputy in 2023, so the congressman must continue to respond in the process with former President Bolsonaro.
Ramagem Defendant in the STF
The Supreme Court has accepted the complaint of (Attorney General’s Office) against branch and 7 others accused, including Bolsonaro, for attempted coup in 2022 and 4 other crimes.
Ramagem, former director of ABIN (Brazilian Intelligence Agency) in the Bolsonaro government, is accused of joining the central core of a criminal organization that would have planned actions to prevent the inauguration of the then-elected president (PT).
PGR’s complaint also says that the deputy would have acted in favor of the dissemination of false information about the electoral system and the attempt to delegate “Democratic institutions”. Ramagem nega.
In addition to the congressman, another 7 respond to the same process in the STF. They are:
- Jair Bolsonaro -Former President of the Republic;
- Almir Garnier -Former Navy Commander;
- Anderson Torres -Former Justice Minister;
- Augusto Heleno -Former GSI Minister (Institutional Security Office);
- Mauro Cid -former assistant of Bolsonaro’s orders;
- Paulo Sérgio Nogueira -Former Defense Minister; and
- Braga net -Former Minister of the Civil House and candidate for vice president in 2022.
PL arguments for annulment
The case against Bolsonaro was done by the PL leader in the House, (RJ), on April 1. The request is based on EC (Constitutional Amendment) 53 of the Constitution, which allows parties to ask for a criminal action ongoing against congressmen in the exercise of the position to be interrupted.
The interpretation of the opposition is that if the low house approved the request, the interruption of the progress of the action was extended to Bolsonaro and to the other 7 reported by PGR.
