The minister, of the (Supreme Federal Court), blocked on Wednesday (30) the execution of parliamentary amendments of health of 1,283 not regularized accounts. The measure should last until the Ministry of Health’s specific request attesting to the regularization of the account, on a case by case basis.
“Due to the absence of opening and/or regularization of specific accounts, individualized by amendment, there is no alternative but the blockade of parliamentary health amendments,” says the minister.
Dino determined that the Ministry of Health provides up -to -date information on compliance with the determination given by him last year about opening specific accounts for the receipt of resources from each health intended.
The minister is the rapporteur in the supreme of the process he investigates from the House and Senate.
The AGU (Attorney General of the Union) reported that the order was not fully fulfilled as set in August 2024. According to AGU, 6,040 accounts were regularized, but the 1,283 still left.
Currently, a Normative Instruction of the TCU (Federal Court of Audit) requires that, in special transfers, specific current accounts be created for each author and for each year of the amendment. From the decision of Minister Dino, this requirement was extended to parliamentary amendments in the health area.
This measure, according to the TCU, can increase the traceability of transfers from the last six years of 19.1% to 87%.
“I remember that such determinations regarding the opening of specific accounts are not unprecedented and are contained in other orders/decisions made by this rapporteur since August 2024. Flexibility regarding deadlines demonstrates consideration in the conduct of the present case, but it is certain that it is not possible to wait indefinitely for the fulfillment of constitutional duties by public managers,” says Dino.
On December 31, the rapporteur complied with a request from the Lula government () and released the commitment of parliamentary amendments to comply with the constitutional floor of the. The AGU triggered the STF by stating that it endangered it to comply with the floor.
By the executive accounts, there were still R $ 2.1 billion to be intended for health in that date in 2024, and to reach that amount, it would be necessary about R $ 370 million in commission amendments.
Dino answered releasing the commitment only of the necessary to achieve “the value necessary to achieve the constitutional health floor”.
He also required that, until March 31 this year, the health committees of the and federal s – the lack of this information was one of the factors that led to the initial blockade.
The release was worth only for the commitment of the amendments. Dino determined that the execution could only occur after this ratification made by Congress.
