The minister, of the (Supreme Federal Court), released on Wednesday (30) access to all evidence collected by the defense of the former president () no.
To comply with the measure, the rapporteur set a five-day period for the Federal Police to inform the best way for defenses and (Attorney General’s Office) to have full access to all material seized during investigations of the case.
“The Federal Police should maintain confidential eventual documents, media, audios and videos that contain intimate facts linked to the private life of all accused. In this case, the court must be communicated and the defenses must make specific requirements,” added Moraes.
The request had been submitted in the prior defense of Bolsonaro, delivered to the Supreme on Tuesday (29) – last day of the deadline started last Wednesday (24), when the (Intensive Care Unit) in Brasilia.
The minister said he accepts the request for “immediate access to the full probative set collected in the course of investigations and, especially, the full content of cell phones and other media seized and partially used by the accusation.”
In the same order, the rapporteur responded to the defenses of the other seven defendants in the same nucleus of Bolsonaro.
Unrestricted access to the complete material that supported the indictment and the complaint was a claim of lawyers since the beginning of the case.
Among the evidence gathered by the Federal Police are the full cell phones seized during the investigation, computers, cloud stored data, geolocation, a list of entry and exit of the palace of Alvorada and physical documents.
In the document sent to the Supreme, the defense of the former president also requested authorization to participate in the hearings of other processes related to the coup plot. This point, however, the minister says he will decide “at the proper procedural moment”.
In the decision, Moraes also lists the witnesses that will be heard throughout the instruction of the process. There are 15, in total, indicated by Bolsonaro, the total pointed out by the defense of the former president.
Among them are the governor of, (Republicans), former military commanders and parliamentarians.
