TRE-SP had revoked Beto Piteri and Dr. Claudia for misuse of the media during the 2024 elections; Court also determined that both would leave office
The Minister of the TSE (Superior Electoral Court) Nunes Marques suspended on Thursday (1st.MAI.2025) the decision of the TRE-SP (Regional Electoral Court of São Paulo) which revoked the diplomas of the mayor of Barueri (Republicans), and the deputy mayor, Dr. Claudia (PSB). On Monday (28.abr), the Court of Sao Paulo had determined that Piteri and Claudia leave office immediately for misuse of the media. On April 8, of the current mayor and Rubens Furlan-the city’s mayor-for 8 years.
At the time, according to the decision of TRE-SP, the irregularity was due to the release of videos driven on Furlan’s profile on Instagram to publicize Piteri’s electoral campaign and depreciate the opponent candidate (União Brasil).
Nunes Marques’ decision came after the deputy mayor’s defense filed an appeal against the immediate decision to remove the plate from office. He stated that there was not enough evidence and that the measure violated the case law of the TSE.
The minister accepted the allegation and determined that the case still needs to be analyzed by the plenary of the Court.
“It is verified that the act of co-worker-an acorder given by the TRE-SP-appears to be in dissonance of precedents of this Court according to which the decisions of the regional courts that imply the cancellation of a Candiato diploma elected in the municipal elections must be fulfilled after the exhaustion of ordinary instances, except for the precautionary provision before the extraordinary instance.”said Nunes Marques.
