The analysis of the House of Representatives about a criminal action for attempted coup attempt against Deputy Alexandre Ramagem (PL-RJ) may directly benefit former President Jair Bolsonaro (PL). Allies of the former president want the whole process, which also has Bolsonaro as a defendant, be suspended based on an excerpt from the Federal Constitution.
The document was filed by PL, the former president’s party, and asks the House to lock the process judged by the First Class of the Supreme Federal Court (STF) which made Ramage and Bolsonaro Defendants.
On March 26, the ministers of the collegiate accepted the complaint against them and included them in the same process, who will judge members of the “crucial core” who led the attempted coup after the 2022 elections.
Both Bolsonaro and branch are defendants for the crimes of coup d’état, attempted violent abolition of the Democratic Rule of Law, criminal organization, qualified damage and deterioration of listed public assets. Added, the penalties for these crimes can reach 43 years in prison.
The PL is based on an excerpt from the Constitution that gives the House the power of the progress of a criminal action while the parliamentarian maintains his mandate. On the day the document was sent to the Board of Directors, the party leader at the House, Sostenes Cavalcante (RJ), said that a possible suspension of the process would benefit all defendants. “This was the best news of the day for the defense of President Bolsonaro,” he said.
In the document sent to the House, the PL claims that all alleged crimes imputed to branch were committed after his diploma on December 19, 2022. The party used as an example the scammer acts of January 8. “Because the crime of armed criminal organization, which has a permanent nature, would have extended until January 2023, and the other imputed crimes would have occurred on January 8, 2023,” he said.

The document is being analyzed by the Chamber Constitution and Justice Commission (CCJ). The rapporteur in the collegiate is the scholarship federal deputy Alfredo Gaspar (Union-AL). On Wednesday, 30, the parliamentarian argued that the criminal action should be sustained in full, which may also suspend Bolsonaro’s trial.
“Considering the need to give autonomy and independence to the mandate exercised by the legitimately elected parliamentarian, there is no alternative to this house other than the fruousness of criminal action in its entirety,” said Gaspar in the text presented on Wednesday.
The deputy also said that the suspension serves to “avoid the instrumentalization of the judicial process.” “The possibility of sustaining the criminal action against congressmen aims to avoid the instrumentalization of the judicial process in order to embarrass, to tenure, to threaten the accused parliamentarian, compromising his freedom in the exercise of his mandate,” he said.

After reading Gaspar’s vote, the analysis was paralyzed by a collective request (more time for analysis), made by deputies of President Luiz Inacio Lula da Silva (PT) base. The text vote should be for next week.
As a reaction to the Bolsonarist movement to suspend criminal proceedings against Bolsonaro, STF Minister Cristiano Zanin, who presides over the first class of the Supreme Court, sent a letter to the House to inform that the process cannot be sustained in its entirety.
In addition to the approval of at least 34 members of the CCJ, the measure must be approved by 257 deputies in the plenary.

The complaint of the Attorney General’s Office (PGR) accepted by the Supreme Court says that while heading the Brazilian Intelligence Agency (ABIN), Ramagem helped Bolsonaro triggest the coup plot, disbelieving the electronic ballot boxes and opponents in the procedure that would have culminated in the attempt to take power. The deputy remained in office until March 2022, when he was unzipped to apply for the House.
The Federal Police (PF) states that he has become one of the former president’s leading counselors and articulated attacks on the Supreme Court. Message exchanges pointed out, according to investigations, that Ramagem encouraged Bolsonaro to confront the ministers. The deputy’s defense classified the evidence as “shy” and denied his involvement in scammer acts.
